Nothing in this Agreement shall be considered, by implication or otherwise, as a grant of any right or license by the Disclosing Party to the Receiving Party with respect to its Confidential Information.2.4The Confirmer has been informed that the information disclosed is protected as trade secret and its disclosure may give rise to liability.3Obligations and liability of the confirmer3.1The Confirmer shall not disclose, directly or indirectly, Confidential Information to any third parties, without a prior written consent of the Disclosing Party.3.2The Confirmer commits to apply all measures neccessary in order to avoid disclosure of Confidential Information to the third parties.3.3The Confirmer is obliged to immediately notify the Disclosing Party if the Confidential Information has come to knowledge of the third parties. The Confirmer commits to apply all reasonable measures neccessary in order to minimise the possible damages to the Disclosin Party.3.4Upon the respective request submitted by the Disclosing Party for whatever reason, the Confirmer shall immediately return all Confidential Information furnished to it hereunder in writing or in any other tangible form which can be returned; if the Confidential Information has been provided or stored in electronic, digital or other similar form, it shall be destroyed by the Confirmer.
